Introduction

Welcome to UmiVPN. These Terms of Service ("Terms") govern your access to and use of UmiVPN services and any software provided by 5V Network LLC (collectively, the "Service" or "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.

Acceptance of Terms

By creating an account, accessing, or using Services, you acknowledge that you have read, understood, and agree to be bound by the Terms and our Privacy Policy. Terms constitute a legally binding agreement between you and 5V Network LLC.

Cancelation and Refund Policy

You may cancel your subscription at any time. Upon cancellation, your subscription will remain active until the end of your current billing period, after which it will not renew. All subscription fees are non-refundable. We do not provide refunds or credits for any partial subscription periods, unused portions of your subscription, or for any reason, except as required by applicable law or applicable app stores. By purchasing a subscription, you acknowledge and agree that all payments are final and non-refundable.

Prohibited Use

You agree not to engage in any of the following prohibited activities. Violation of these terms may result in immediate account termination without refund and potential legal action.

• Selling, reselling, trading, or otherwise commercializing VPN server crendentials that we provide or account access
• Sharing, publishing, or distributing the IP addresses of our VPN servers or any other technical information about our infrastructure
• Using the service for any illegal activities or in violation of any applicable laws or regulations
• Attempting to interfere with, disrupt, or harm our service, servers, or network infrastructure
• Your UmiVPN account is personal and non-transferable. You are strictly prohibited from sharing your account credentials, login information, or access to your account with any other person. Each user must create their own account.
• Reverse engineering, decompiling, or disassembling our applications
• Accessing, calling, or interacting with API endpoints that are used by our applications through any means other than our applications. This includes, but is not limited to, making direct HTTP requests, using third-party tools, scripts, bots, or any automated programs to access the API endpoints. You may only access the endpoints through our official mobile and desktop applications. Any unauthorized access to the API endpoints may result in immediate account termination without refund.

Disclaimer of Warranties

We make reasonable efforts to improve the accuracy and reliability of our Services, but complex software is never entirely free from defects, errors, or bugs. We make no warranty or representation that our Services will be wholly free from defects, errors, bugs, downtime, data loss, data corruption, service delays, inaccuracies, or other issues. Notwithstanding any other provision of these Terms, we reserve the right to modify, suspend, or terminate access to our Services, or any functionality comprising a part of our Services, at any time without liability. In exceptional circumstances, our Services may be unavailable due to human, technical, mechanical, telecommunication, software, or other failures. We cannot predict or control when such downtime may occur or its duration.

The Services are provided “as is” and “as available,” including all defects. We make no guarantees or warranties of any kind regarding the Services, including their completeness, accuracy, reliability, suitability, functionality, availability, or operation. You acknowledge that we do not control how you use the Services and do not guarantee any specific results from such use. You accept full responsibility and all risks associated with using the Services, including any loss of data or errors in information.

Limitation of Liability

You use the Services entirely at your own risk. UmiVPN and its affiliates, officers, employees, and directors shall not be liable for any damages of any kind—whether direct or indirect, incidental, special, punitive, or consequential—including, without limitation, loss of data, loss of business, lost profits, business interruption, or any other losses—arising from or related to these Terms or your use of, or inability to use, the Services, regardless of the legal theory involved and even if advised of the possibility of such damages. In all cases, our total aggregate liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim.

Some jurisdictions restrict or do not allow the limitation of liability in contracts. In cases where such restrictions apply, the liability of UmiVPN shall be limited to the fullest extent permitted by applicable law.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the service after such changes constitutes your acceptance of the modified Terms.
